Sanofi settles US patent litigations
19 Nov 2008
Medical Affairs
Sanofi-aventis has announced the settlement of patient litigations in the US relating to its Allegra and Nasacort medicines.
In exchange for royalty payments, the company has agreed to grant Barr Pharmaceuticals and Teva Pharmaceuticals a licence to certain patent rights which will enable them to sell generic versions of Allegra 30 milligrams (mg), 60 mg and 180 mg tablets in the US.
As part of the agreement the firm has also granted Barr a non-exclusive licence to certain patent rights to sell generic versions of the Allegra D-12 and Nasacort AQ products in the US at a future date.
With regard to the payment of royalties, the Sanofi statement confirmed: "With respect to Allegra, for which Barr and Teva already market a US generic, royalties are to be retroactively applied to past sales."
Sanofi continues to be involved in patent disputes with other companies in relation to Allegra and Allegra D-12, which it confirmed remain unaffected by its agreement with Barr and Teva.
Meanwhile, the company's vaccines division Sanofi Pasteur has revealed that Russia has chosen its inactivated polio vaccine for use in an immunisation programme of all infants in the country.
