Mylan wins lawsuit against AstraZeneca

Mylan has won a lawsuit which was brought against the company by AstraZeneca over Mylan's generic version of the heartburn drug Prilosec.

The US Court of Appeals for the Federal Circuit has agreed with the District Court ruling made in May last year which said that Mylan's Omeprazole capsules do not infringe AstraZeneca's patents on Prilosec.

Mylan vice-chairman and chief executive officer Robert Coury said: "Once again, we are pleased to have prevailed in court, and we believe that this decision ends the patent litigation surrounding this product for our company."

He added that "consumers, the government and third-party payers have benefited significantly for nearly five years because they've had access to a lower-cost generic version of Prilosec".

Omeprazole was launched on August 4th 2003.

In related news, Mylan yesterday announced that final approval for an Abbreviated New Drug Application for Zaleplon Capsules has been given by the US Food and Drug Administration.
