Ambrilia seeks arbitration with Merck

31 Dec 2008

Regulatory Affairs

Ambrilia Biopharma is seeking arbitration with the International Chamber of Commerce (ICC) over licensing and confidentiality agreements with Merck.

The biotechnology firm claims Merck has not met its obligations to an HIV programme on which the two companies began collaborating in October 2006.

"Our team at Ambrilia has worked hard and been successful in building a strong HIV protease inhibitor programme with corresponding intellectual property," said Dr Phillipe Calais, president and chief executive officer of Ambrilia.

The firm said it had attempted to resolve the dispute with Merck but concluded that requesting arbitration would be the most efficient resolution to the situation.

Dr Calais added that Ambrilia believes it will prevail in any mediation by the ICC.

Merck recently donated $8 million (£5.5 million) worth of grants to more than 200 non-profit and community-based organisations to combat HIV and AIDS in the US and worldwide.

One of the charities which benefited from the money was the Text to Change Foundation in Uganda.
