    Mylan and Schering-Plough settle patent dispute

    Mylan and Schering-Plough have settled patent litigation relating to a generic version of allergy medication Clarinex.

    Under the terms of the deal, most of which have remained confidential, Mylan will be able to market its form of the treatment from July 1st 2012, or before under certain circumstances.

    The settlement is also subject to review by the Department of Justice and the Federal Trade Commission.

    Once it gains the right to market its generic drug, it may be in prescription form or an over the-counter version, depending on the status of Clarinex at the time.

    The tablets generated around $248 million (£169 million) worth of sales last year, according to IMS Health data.

    Meanwhile, AstraZeneca this week commenced legal proceedings against Apotex over its application to market a generic version of the Anglo-Swiss firm's asthma treatment, Pulmicort.

    AstraZeneca is seeking a declaration of patent infringement, as well as a prohibition order to prevent Apotex from selling its form of the medication.
